Terms & conditions

General terms governing the services delivered by Atlas Contrôle ASBL and Atlas Controle SRL.

Important: This English version is a courtesy translation. The legally binding text is the French version or Dutch version as required by Belgian law. In case of discrepancy, the French or Dutch text prevails.

1. Scope

These general terms apply to all inspection services delivered by Atlas Contrôle ASBL, accredited inspection body (FPS Economy & BELAC ISO 17020 — No. 663-INSP), Rue Eugène Smits 58, 1030 Schaerbeek (enterprise No. BE 0732.536.476), and by Atlas Controle SRL, Boulevard Lambermont 127, 1030 Schaerbeek (enterprise No. BE 1002.000.201), together or individually referred to as "Atlas Contrôle". The customer's contracting party is the entity that issues the quote or, failing that, the invoice.

2. Service offer

Atlas Contrôle delivers technical inspections of electrical, gas, propane, EPC, boiler, fire detection, BRUGEL and high-voltage installations, in accordance with applicable Belgian standards (RGIE, NBN, regional decrees).

3. Quote & order

Quotes are valid three (3) months. The order becomes firm upon the customer's signed order form or online confirmation; the contract is concluded when Atlas Contrôle confirms the order.

4. Pricing & payment

The prices in force on the date of the order apply. Prices are inclusive of VAT for consumers and exclusive of VAT for professionals. Payment is due upfront, before the report is released, by Bancontact, credit card or bank transfer. Professional customers with a written account agreement may pay by invoice within 30 days.

Rates are adjusted once a year, on 1 January, according to the evolution of the "Agoria Manufacturing" reference labour-cost index (base January 2010 = 100), using the formula P1 = P0 × [ 0.80 × (S1 / S0) + 0.20 ], where S1 is the index value for the October preceding the adjustment and S0 its value for October of the year before. Adjusted rates are published on this website at least 30 days before taking effect.

5. Cancellation

Cancellation or rescheduling by the customer up to 72 business hours before the scheduled appointment is free. Between 24 and 72 business hours: 50% of the price is due (minimum €50 incl. VAT). Less than 24 business hours, no-show or no access to the installation: 100% of the price is due (minimum €100 incl. VAT). A cancellation notified on Friday for a Monday appointment counts as less than 24 business hours.

6. Inspection report (PV)

The official inspection report is issued in French (Brussels & Wallonia) or Dutch (Flanders) as required by Belgian law. An English summary is provided free of charge on request. The report is signed electronically and delivered within 24-48h after the on-site visit.

7. Liability

Atlas Contrôle is only liable for direct damage; indirect damage (loss of business, production, turnover, profit or clientele) is excluded. Its liability is capped, per claim, at twice the amount invoiced for the service concerned, within the limits of its insurance cover. The inspection covers the visible and accessible parts of the installation at the date of the visit; subsequent modifications by the customer or third parties are not covered.

8. Complaints

Complaints must be filed in writing within 30 calendar days of discovering the issue, via our complaint procedure; any legal action must be brought within 12 months of the service. These time limits apply without prejudice to mandatory statutory periods and consumer rights.

10. Applicable law & jurisdiction

These terms are governed by Belgian law. For disputes with businesses (B2B), the courts of the district of the place of business of the contracting Atlas Contrôle entity (Brussels) have exclusive jurisdiction; for disputes with consumers, the statutory rules on territorial jurisdiction apply.

11. Independence & impartiality

Atlas Contrôle commits to absolute impartiality and independence from manufacturers, installers and parties to the transaction. Inspections under ISO 17020 accreditation are performed by Atlas Contrôle ASBL. Our inspectors do not perform corrective work themselves.

12. Confidentiality

All information collected during the inspection is treated confidentially and is only shared with parties identified by the customer (notary, grid operator, real estate agent, etc.) or where disclosure is required by law (e.g. supervisory authorities).

13. Final provisions

Atlas Contrôle reserves the right to update these terms. The version applicable is the one in force at the time of order. Any amendment is communicated to the customer prior to its application.
